El día de hoy, el director ejecutivo de Lima 2019, Carlos Neuhaus Tudela, sustentó el Proyecto de Ley 3914/2018-PE frente a la Comisión de Presupuesto y Cuenta General de la República del Congreso de la República.
Seguidamente, presentó los principales avances en la organización y construcción de las sedes para los Juegos Lima 2019 ante los congresistas presentes.
Medidas en materia de contratación pública
Today, the Lima 2019 Executive Director Carlos Neuhaus Tudela supported the Bill of Law 3914/2018-PE to the Congress Budget and General Account Committee.
Then, he introduced to Congress members the progress already made in the organization and construction of venues for the Lima 2019 Games.
Public Procurement Measures
“The Pan American and Parapan American Games are a state commitment based on responsibility agreements with the governing bodies of these important international competitions,” he said referring to Panam Sports, the International Paralympic Committee and the Americas Paralympic Committee. These three bodies are responsible for transmitting the requirements of the Olympic Committees of the 41 countries that will participate in this sports festival.
That is why the Executive presented the bill to the Congress to implement mechanisms that allow the Special Project to procure timely and efficiently goods and services required for the organization and development of the Games. Under no circumstances will construction works be procured.
All within the originally approved budget; unlike other major sporting events –held in the last 30 years–, where the original budgets increased between 85 and 900% in all cases.
Neuhaus argued that this Law is necessary, pointing out that it would allow the management of contingencies arising at the last moment, because the legal deadlines set forth in the Government Procurement Law could hinder the opportunity of meeting the need.
“This measure will require that the Special Project issues guidelines regarding procurement process under 400 thousand soles. This will be of public knowledge and will be published on the Lima 2019 website,” he stressed.
“The special procedure established in the bill of law determines strict compliance with the principles of public procurement, such as free competition and participation, efficiency, transparency, etc. The exception of the regulation will only reduce deadlines, and avoid targeted procurement,” he emphasized.
Meanwhile, Neuhaus said that the Comptroller General of the Republic will participate in the follow-up of these contracts, and explained that the initiative of the Executive will not exclude the Special Project of the National Control System, nor supervision and control measures of State when using public resources.
"This will enable and strengthen such measures, requiring that the Special Project publishes all the contracts in the SEACE (Electronic System of State Procurement),” he said.
Finally, he warned that the approval of exemption regulations for contracting has important precedents in the country.
“The same occurred in events such as APEC, 2015 Peru Board of Governors of World Bank Group/International Monetary Fund, where exemption regulations were approved –in certain cases–to be exempted from the Government Procurement Law,” he explained.
Exemption from the prohibition of motor vehicles procurement
Additionally, this proposal considers that Lima 2019 may procure automotive vehicles, in order to set out a better procurement strategy for the market, enabling two possible services (rent and/or acquisition).
This is only to maximize the use of public resources, taking into consideration that they could remain as a legacy for institutions or public entities that may need them.
Financial transfers in favor of the Pan American Sports Organization
In this regard, this proposal is raised as a measure to mitigate the generation of higher risks in the procurement of accommodation and accommodation services necessary for the development of the Games.
As PASO is not within the scope of the procurement regulations, it has higher flexibility to negotiate and obtain better market conditions and, consequently, optimize the use of public resources, ensuring prices and conditions for optimum provision of services.
Approval
After the support of the Lima 2019 Executive President, the members of the Congress Budget and General Account Committee approved the Bill of Law 3914/2018-PE, which will allow exceptional measures to be taken in the event of unforeseen emergencies and demands of the organization of the Pan American and Parapan Games.
Various congress members congratulated the work carried out by COPAL.
“For those of us who have been athletes, when we see the work that the Organizing Committee is doing, we only have to say that they are doing an excellent job, and that it is very positive for the Peruvian youth to form better citizens with values and discipline," said legislator Carlos Tubino of Fuerza Popular.
